THIS INDENTURE made the thirtieth day of November in the year of our lord one thousand eight hundred and fifty Between Henry Coxhead of the parish of Saint Lawrence in the isle of Thanet in the county of Kent gentleman and Robert Strong Cramp of Ramsgate in the said isle of Thanet and county of Kent brewer of the one part and John Mercer of Ramsgate aforesaid gentleman of the other part  WHEREAS Sarah Fowler late of Ramsgate aforesaid widow and relict of Joseph Fowler then late of the same place coach master being seised and possessed of the hereditaments and premises hereinafter described and intended to be hereby granted and release with their appurtenances by her last will and testament in writing bearing date the fourteenth day of May one thousand eight hundred and forty seven duly executed and attested After devising certain parts of her real estate (not comprehending the hereditaments and premises hereinafter particularly mentioned and described  and intended to be hereby granted and released) unto her son in law the said Henry Coxhead and her friend the said Robert Strong Cramp and their heirs upon certain trusts therein mentioned and bequeathed certain parts of her personal estate in manner therein mentioned As to all the other her messuages lands tenements hereditaments parts or share of hereditaments and all other her estate whatsoever and whatsoever as well real as personal which she should be seized or possessed of or intitled unto or over which she had any right or disposing power whatever at law or in equity The said testator Gave devised and bequeathed the same and every part thereof with appurtenances Unto her said son in law the said Henry Coxhead and Robert Strong Cramp their heirs executors administrators and assigns according to the nature of the estate respectively Upon trust that they her said trustees and the survivor of them and the heirs executors administrators and assigns of such survivor according to the nature of the estate should and did as soon as conveniently might be after her decease sell and dispose of such part and parts of  her said estate and effects as should be freehold or leasehold or of the nature of freehold or leasehold either together or in parcels for the best price or prices that could be reasonably obtained for the same And upon payment of the purchase money for the same should and did convey and assign the same to the purchaser or purchasers thereof and his her or their heirs executors administrators or assigns according to the nature of the estate were the same real or personal And for facilitating such sale and disposition of her said freehold and leasehold estates The said Testatrix did hereby declare that the receipt or receipts of here said trustees or of the survivor of them or of the heirs executors administrators or assigns of the survivor of them according to the nature of the estate should be a sufficient discharge to any purchaser or purchasers of all or any part of her said freehold or leasehold estates for his her or their respective purchase money or so much thereof as in such receipt of receipts should be acknowledged or expressed to be received and that such purchaser or purchasers his her or their executors administrators or assigns should not afterwards be answerable or accountable for any loss misapplication or nonapplication of such purchase money or any part thereof AND WHEREAS the said Sarah Fowler departed this life on the second day of January one thousand eight hundred and forty nine without having revoked or altered her said in part recited will which was on the twenty forth day of march one thousand eight hundred and forty nine duly proved by the said Henry Coxhead and Robert Strong Cramp the executors thereof in the prerogative court of the archbishop of canterbury AND WHEREAS the said Henry Coxhead and Robert Strong Cramp in pursuance of the trusts contained in the said hereinbefore recited will of the said Sarah Fowler deceased have contracted and agreed with the said John Mercer for the absolute sale to him of the hereditaments and premises hereinafter particularly mentioned and described and intended to be hereby granted and released with their appurtenances and the fee simple and inheritance thereof in possession free from incumbrances at or for the price or sum of seven hundred and thirty five pounds being the best price that could be obtained for the same NOW THIS INDENTURE WITHNESSETH that in pursuance of the said recited contract and in consideration of the sum of Seven hundred and thirty five pounds of lawful money of Great Britain to the said Henry Coxhead and Robert Strong Cramp (as such trustees as aforesaid) in hand paid by the said John Mercer at or immediately before the execution of these presents the receipt whereof the said Henry Coxhead and Robert Strong Cramp do hereby acknowledge and thereof do and each of them doth release and discharge the said John Mercer his heirs executors administrators and assigns for ever by these presents  They the said Henry Coxhead and Robert Strong Cramp in pursuance of the trusts reposed in them by the said hereinbefore recited will of the said Sarah Fowler deceased Do and each of the Doth by these presents grant release and convey unto the said John Mercer his heirs and assigns ALL THAT piece or parcel of land or ground with the coach houses stables and buildings now or lately standing and being thereon situate lying or being on Clover hill in Ramsgate aforesaid in the said isle of Thanet and county of Kent Abutting and adjoining to Clover hill aforesaid in front towards the north east and containing by admeasurement on that side thereof two hundred and fifty five feet and five inches of assize little more or less to a three feet passage towards the south east and containing by admeasurement on that side thereof eighty five feet and five inches of assize little more or less to hereditaments and premises of the devisees of the late Richard Thompson deceased in part and to hereditaments of the said John Mercer in other part towards the South west and containing by admeasurement on that side thereof on hundred and forty four feet five inches of assize little more or less and to hereditaments and premises of messieurs Robert and James Austen towards the west and north west and containing by admeasurement on those sides thereof one hundred and six feet and thirty six feet and four inches of assize little more of less which said piece or parcel of land and hereditaments intended to be hereby granted and released were formerly in the tenure or occupation of messieurs John and Joseph Fowler and late of the said Sarah Fowler deceased or of her assigns or undertenants and were purchased by the said John Fowler deceased with other hereditaments of and from John Heritage of Watling street in the City of London silk manufacturer and the same were by indenture of lease and release bearing date respectively the third and forth days of October one thousand eight hundred and four conveyed and assured to the said John Fowler as therein mentioned and the same hereditaments and premises were particularly delineated and described in the maps or plan thereof indorsed on these presents And all houses outhouses edifices buildings ways paths passages easements liberties  privileges profits commodities advantages emoluments rights members and appurtenances whatsoever to the said hereditaments and premises thereinbefore described belonging or appertaining AND the reversion and reversions remainder and remainders rents issues and profits thereof and of every part thereof AND all the estate right title interest use trust inheritance property benefit claim and demand whatsoever both at law and in equity or otherwise of them the said Henry Coxhead and Robert Strong Cramp and each of them of in and out of the same hereditaments and premises AND ALSO all deeds evidences and writings concerning the title to the said hereditaments and premises only or any part thereof only now in the custody of them the said Henry Coxhead and Robert Strong Cramp or either of them or which they or either of them can procure without suit TO HAVE AND TO HOLD the said piece or parcel of land coach houses stables buildings and all and singular the hereditaments and premises hereby granted and released or intended so to be with their appurtenances unto and to the use of the said John Mercer his heirs and assigns for ever AND the said John  Mercer doth hereby declare that any wife of him the said John Mercer who should happen to survive him shall not be entitled to dower out of or in the same hereditaments and premises or any part thereof AND each of them the said Henry Coxhead and Robert Strong Cramp severally and apart for the other of them and as and concerning his own acts and defaults only doth hereby for himself his heirs executors and administrators covenant and declare with and to the said John Mercer his heirs and assigns that they the said Henry Coxhead and Robert Strong Cramp  respectively have not done or permitted any act deed matter or thing by means whereof the said hereditaments and premises hereby granted and released or intended so to be or any part thereof with their appurtenances are is can shall or may be aliened incumbered or prejudicially effected in title estate or otherwise howsoever AND ALSO that the said Henry Coxhead and Robert Strong Cramp or one of them their or one of their heirs executors of administrators shall and will at all times hereafter upon every reasonable request and at the expense of the said John Mercer his heirs or assigns (unless prevented by fire or other inevitable accident) produce or procure to be produced to him or them or to his of their counsel solicitor or agent in any court of law or equity or other judicature at or elsewhere in England as occasion shall require a certain deed poll bearing date the twenty second day of may one thousand eight hundred and forty three under the hand and seal of the said Sarah Fowler deceased for the manifestation and defence of the estate right and title of the said John Mercer his heirs or assigns in and to the said hereditaments and premises hereby granted and released or any part thereof AND ALSO shall and will at the like request and expense furnish an abstract or abstracts or copy or copies of the same deed such copies to attested if required IN WITNESS whereof the said parties to these presents have hereunto set their hands and seals the day and year first above written.
